A COHRE Focus Country


The Philippines continues to evict hundreds of thousands of people in its cities in the name of 'beautification' and 'development'. Landless urban poor are the worst affected by forced evictions throughout the Philippines. Although housing rights are protected legally by both the Philippines' Consitution and the Urban Development and Housing Act of 1992 (UDHA), the Government of the Philippines continues to use various strategies such as pressuring residents to relinquish these rights by signing waivers and then 'voluntarily' relocating them to sites that are not fit to be lived in.

Faced with forced evictions on a massive scale (e.g. the North-South Rail Project in Manila may displace over 500,000 people), housing rights groups and activists in the Philippines have recently joined forces with communities affected by forced evictions and other housing rights violations to form a Housing Rights Task Force. This move was facilitated by the COHRE Asia-Pacific Programme (CAPP). Building on its fact-finding missions, training and other capacity building work and assistance with international advocacy efforts, CAPP plans to continue efforts to promote the realisation of ESC rights in Filipino society, through ongoing advocacy, training and networking activities both in-country and through fostering links across the region. COHRE is currently working the a network of NGOs to develop shadow reports to the UN Commitee on Economic, Social and Cultural Rights. See below for more information.

In 2007, COHRE awarded the Naga City Government, Philippines, the Housing Rights Protector Award for its Kaantabay sa Kauswagan (Partners in Development) Programme, an initiative providing security of tenure and improved living conditions for thousands of its residents. For more information about the award, click here. This award to Mayor Jesse Robredo and his administration shows that best practice housing rights policies are possible in the Philippines.

Unfortunately, such best practices a quite rare. In 2006, the Philippines was given one of three Housing Rights Violator Awards by COHRE, for the forced eviction and mass displacement of hundreds of thousands of people, and its blatant disregard for the human right to adequate housing.For more information about this award, click here.

Using UN Mechanisms

In 2007 and 2008, COHRE is working with Philippines human rights organisation to engage UN Mechanisms - both the UN Commitee on Economic, Social and Cultural Rights (CESCR), and the Human Rights Council's Universal Periodic Review (UPR) mechanism.

On 3 and 4 October 2007, COHRE, in collaboration with Taskforce RILES and the Philippines Human Rights Information Center (PhilRights) organised two workshops in Manila to coordinate civil society input into Philippines upcoming reports.

The workshops were attended by over 78 people, representing over 40 NGOs, People’s Organisations (POs) and religious organisations from 4 regions of the Philippines. The first workshop was attended by housing rights activists, including community leaders from locations experiencing ongoing demolitions, and the second was attended by representatives from other Economic Social and Cultural (ESC) rights fields such as health, education, food and work.

In November 2007, COHRE and partners submitted a draft list of issues to CESCR. The joint submission of more than 40 organisations was noted by the Committee. This submission was used as the basis of a civil society submission under the UPR, which will be considered by the Human Rights Council in early 2008.

COHRE will continue to work with local partners throughout 2008 to produce a shadow report to CESCR, and to engage with the committee when the Philippines State Party report is considered in late 2008.
